Guest is Attorney Mitchell Garabedian – the attorney who litigated many of the first child sexual-abuse cases in the nation – representing survivors of the clergy abuse taking place in the Catholic Archdiocese of Boston, and around the nation.

Discussion focuses on the serial predators: “clandestine clergy” cloaked in the ‘cloth,’ yet hiding their true nature behind religion and the church – using it as a pretense  to “prey” upon vulnerable children and their unsuspecting parents. Child predators making their  way into family circles – becoming trusted confidants and revered family members – all the while – exploiting their children.

♦ Show Topic: Unmasking the First Amendment – Litigating Freedom of Information, & Office of Legal Counsel Opinions

Guest: Attorney Stephanie Krent, of the Knight First Amendment Institute at Columbia University.  The Institute’s mission, is to defend freedom of speech and the press in the digital age – through strategic litigation, research, & public education.

What are the often discussed OLC Opinions and what is their importance? In this interview, Attorney Krent outlines how the Office of Legal Counsel – an office within the US Justice Department functions, how it assists the Attorney General and is both legal adviser to the President and all Executive Branch Agencies.

Discussion on how often the OLC keeps many of its opinions “secret” – away from  public scrutiny, and the attorneys who need to understand its findings. Most importantly, those outside of government can neither comply with it, nor challenge its rulings if they are kept secret.

Even when there is no national security issues requiring OLC to keep opinions from public view, it has nevertheless become standard practice to keep many of its opinions secret. In an era when the call to increase transparency and accountability in the executive branch of government, it is all the more imperative to make the law clear to the American public.

This “secretive” process has been an ongoing problem through many presidencies, yet none more notable than under the Trump administration.

From the issues surrounding the Mueller Report, including whether a ‘sitting president’ can be prosecuted for a crime while in office – to a host of other executive branch regulatory opinions – OLC sits at the head of the table. The Knight First Amendment Institute challenges the need for secrecy in the courts – litigating for the public good – to bring sunlight to hidden issues, to ultimately benefit the American people – because, Democracy dies in darkness.

Show Topic:The Sound of Silence – The Hidden Epidemic of Domestic Abuse and Trauma

Guest: Judith Herman, MD, formerly a full-time Professor in the Department of Psychiatry, at Harvard Medical School; and co-founder former Director of Training at the Victims of Violence Program in the Department of Psychiatry, at Cambridge Hospital, Cambridge, Massachusetts; Author of several books, including the groundbreaking book, Trauma and Recovery, The Aftermath of Violence – From Domestic Abuse to Political Terror.

Dr. Herman discusses the pervasiveness and insidiousness of domestic violence and abuse. How victims often suffer in silence, and how the institutions that should be protecting them, often do not. She recounts how many victims feel revictimized by the system, their families and societies. Dr. Herman elucidates the cycle of abuse, how to identify the signs of abuse, and what to do to break free of it when an abuser won’t get help.

Further discussion on the treatment of women by patriarchal societies and the pervasiveness of institutional bias against victims and even Congressional witnesses: from Professor Anita Hill’s congressional testimony in 1991, to Dr. Christine Blasey Ford in 2018 – both alleging sexual improprieties of powerful men – yet those men were still elevated to US Supreme Court justices on the nation’s highest court.

Herman focuses on how women victims need to shift the paradigm and stand up for their rights. She elaborates the importance of the SurvivorsAgenda – a movement creating a national conversation – a recognition on how women’s rights are human rights, and that all people deserve equal dignity and treatment under the law, and in society.

Show Topic: The International Bill of Human Rights – Politics & Priorities – Where Does America Stand?

Guest: Attorney, Jamil Dakwar, Director of the American Civil Liberties Union’s Human Rights Program (HRP) – dedicated to holding the U.S. government accountable to its international human rights obligations and commitments.  He leads a team of lawyers and advocates who use a human rights framework to complement existing ACLU legal and legislative advocacy, primarily in the areas of counter-terrorism, racial justice, immigrants’ rights, women’s rights, and criminal and juvenile justice. Before joining the ACLU in 2004, Atty. Dakwar worked at Human Rights Watch, and outside the United States as senior attorney with Adalah: the Legal Center for Arab Minority Rights in Israel. Currently he is an adjunct professor at Hunter College and John Jay College of Criminal Justice in New York City.

Our discussion is on the International Bill of Rights – (3 parts) including: the International Covenant on Civil and Political Rights (ICCPR), the Universal Declaration of Human Rights (UDHR) adopted in 1948 after WWII, and the International Covenant on Economic, Social & Cultural Rights (ICESCR). The International Covenant on Civil and Political Rights, is a “multilateral treaty” adopted by the United Nations General Assembly in December 1966, and put in force in March 1976. Yet, the Trump State Department is weakening the rapport with both the international community, while exacerbating the international norms.

Discussion centers on a newly created Commission on Human Rights – coming together at the behest of US State Department, Secretary of State Pompeo. It appears that the Commission is viewing a need for a “Hierarchy” of Human Rights, placing Religious and Property Rights above other Rights including Cultural, Health, Gender Rights, Women’s Rights, and other rights that have been viewed with equal priority over the decades. Atty. Dakwar talks about the danger of creating this hierarchy of rights, and how it is being negatively viewed by the  international community, as well as scholars, educators and non-governmental View TV ShowsHomeorganizations in the US and abroad. Notably, there is much discussion on the fight for women’s rights and how women and girls can be put in danger if religious and property rights are “prioritized” or are elevated over the rights of women, notably in nation states that are oppressive to women because of fundamentalist religious views. An intriguing discussion on the topics other treaties and conventions of which most Americans are unaware, but nevertheless shaped our foreign policy, and by association, our national security.

A historical account of racial discrimination and family separation policies of a nineteenth century slave-owner president – to family separation policies of today. A survey of the aftermath of Reconstruction and the education system that followed including: the US Supreme Court ruling in “Plessy v. Ferguson” making “Separate but Equal” the law of the land, to “Brown v Board of Education” – striking down ‘Separate but Equal’ as Unconstitutional.

Explanation of the benefits and challenges posed by the ratification of the 13th and 15th Amendments to the US Constitution abolishing slavery, and giving Black Men the right to vote. How Black Americans helped to build the US to what it is today, and how the statues memorializing the Confederacy strike at the core of Black Suffering. Show Topic: Liberty, Justice & Healthcare for None – Litigating the Affordable Care Act (ACA) During COVID

Guest: Attorney, Author, Professor Nicole Huberfeld.

She is Professor of Health Law, Ethics & Human Rights, at Boston University School of Public Health, & Professor of Law at Boston University School of Law.

Her work is at the intersection of Health law and Constitutional law – including the role of “federalism” – the division of national and state government power – as it relates to healthcare and public health.

Prof. Huberfeld has coauthored two books, The Law of American Health Care and Public Health Law, and has published many book chapters, journal articles, and other publications, as well as being quoted in major media outlets such as the New York Times, NPR, Bloomberg, Politico, Modern Healthcare, The Hill, and others.

Discussion on the Litigating the ACA during the COVID CRISIS. Answering the hard questions: Why Trump Administration is Heading to the US Supreme Court on November 10th – to Try, Once Again – to Repeal the Affordable Care Act, When Millions of Americans Rely on it – and it is Now, More Than Ever, Critical to Have it…? And, Why South Carolina Senator Lindsay Graham, states he wants to “kill” the ACA  – at a time when all Americans, including South Carolinians needed it the most. Professor Huberfeld clarifies the ACA, what it brings to states that “adopt” it – and what it could bring to states like South Carolina in healthcare coverage for all those who want and need its coverage during COVID.

Show Topic: Running on Fumes: Biofuels, the Environment & Your Health – COVID Edition

Guest: Stephanie Seneff, PhD, is a Senior Research Scientist at MIT. Her research is at the intersection of Biology, Chemistry and Engineering – which includes the Analysis of Empirical Data from Government, Public & Private Resources – which is used to assess the Potential Detrimental Effects, Upon Human Health and the Environment.

Discussion of the potential relationship between the prevalence of COVID and the use of biofuels in the environment. Dr. Seneff provides insightful analysis of charts and graphs created by scientists and academics that may be a window into why some nations are hit harder with COVID than others.

To substantiate her theory, Dr. Seneff points to environmental data points that appear to correlate the presence of biofuel use in an environment, with the prevalence of COVID. She postulates that biofuels are laden with glyphosate, a toxic chemical used to kill weeds – prevalent in GMO (genetically modified) crops and used on traditional crops at time of harvest. Dr. Seneff opines this toxic weedkiller contaminates the harvest, and the subsequent burning of it as biofuel puts these toxins into the air and water. Her data points suggest the virulence of COVID may be based on the prevalence of biofuel use in the very nations that use it. Could it be just a fluke? Dr. Seneff discusses the probabilities of pure chance in relation to her theory of possible causation. Further discussion on theories, as to why vaping has proved to be as bad or even worse than cigarettes for the lungs.

A fascinating eye-opening discussion as to the “possibility” that “toxic” glyphosate-laden biofuels may have a hand in energizing COVID across the nations.

Show Topic: “The Altered States of America: the Psychological Effects of Donald Trump”

Guest:  Dr. Seth D. Norrholm, PhD, is the Scientific Director, Neuroscience Center for Anxiety, Stress, and Trauma (NeuroCAST), Department of Psychiatry and Behavioral Neurosciences, Wayne State University School of Medicine, Detroit, Michigan. He is an Associate Professor and translational neuroscientist with over 20 years of research experience in furthering the understanding of the neurobiological mechanisms underlying fear, anxiety, trauma, and stressor-related disorders and the psychiatric conditions with which these disorders are found.

Dr. Norrholm has trained in both the “classical” bench-based neurosciences as well as within clinical arenas dedicated to the treatment of mood and anxiety disorders. Together with a network of collaborators, he has employed objective, psychophysiological methods to study the underpinnings of mammalian fear processing, as well as the mechanisms mediating effective treatments for fear and anxiety. Dr. Norrholm is a recognized world leader in post-traumatic stress disorder (PTSD) and Fear.

Discussion on how the conduct of the Trump administration is having lasting effects on the psyches of the American causing anxiety, fear and panic caused in part by routinely providing false information to the American people. From the Coronavirus to whether the Russians meddled in the 2016 election, to irrefutable evidence of climate change to his attempt to deny his ongoing court actions currently in the US Supreme Court that would take-away healthcare coverage for preexisting conditions, and do away with Obamacare during a pandemic.  Why Senate members still support him even though what he proposes is against their own best interests, and why many in his party turn the other cheek even when he insults them to their face and makes outrageous remarks that would make most people enemies for life. Why he routinely sows distrust, and misinforms the public about diseases that can kill the very people who will elect him. Why he can and does pit one group of Americans against the other – and routinely denigrates beloved members of society including heroes and fallen servicemen calling them, “losers and suckers.”

From the public shaming and humiliation to name-calling, Dr. Norrholm delves into motivational behavior, why it continues, why people his supporters and those closest to him excuse it. More pointed discussion on why he would he tell his own supporters that they do not need to wear masks to protect themselves while holding rallies in COVID hot-spots – yet tells renowned Nixon Watergate author that COVID is “the plague.” And why, despite all the palpable lies and mistruths, his supporters continue to follow and support him. Tune-in and listen to this riveting discussion with Dr. Seth D. Norrholm.

Show Topic: “Roundup®” – Is it Ready for Another Trial?…The Monsanto Herbicide Cases

Guest: Dr. Stephanie, Senior Research Scientist at MIT. Her Research Includes Analysis and Synthesis of Empirical Data from Government, Public & Private Resources including: Chemical, Molecular, & Atomic Properties—to Assess the Potential for Synergistic Effect upon Human Health.

Discussion on the multi-million jury awards to those who developed non-Hodgkins lymphoma  where causal evidence suggests and juries have found the regular use of the herbicide “Roundup” as a major causal factor for many of its victims to develop the fatal disease. Several cases are under appeal, but damning evidence at trial indicated the original manufacturer, Monsanto knew of the dangers, but did not disclose them to the consumers who used them. Since Bayer Corporation purchased Monsanto in 2018, it has been embroiled in litigation trying to overturn many of the extraordinary jury awards, and deter thousands of other cases currently already being filed. The cases are a nightmare for those afflicted with terminal cancer, as well as a public relations nightmare for the company.

Show Topic: The Affordable Care Act–Liberty, Justice & Expansion for All…

• Medicaid Expansion • Critical Care •Women’s Health & • COVID-19

Guest: Attorney, Nicole Huberfeld, Professor of Health Law, Ethics & Human Rights, at Boston University School of Public Health, & Professor of Law at Boston University School of Law. Her work is at the intersection of Health law & Constitutional law, and the role of “federalism in health care”–which is the role of the states with regard to actions by the federal government. Professor Huberfeldand often writes about Medicaid.

Discussion on the Affordable Care Act (ACA), also known as Obamacare; how States are faring that have implemented the Medicaid Expansion vs. states that have not. How absence of critical care units in hard-hit communities is affecting rural Americans due to hospital closures and lack of funding. The COVID-19 coronavirus pandemic has put an added strain on hospitals already struggling to care for Americans living in thee rural communities even for routine care, including Women’s health, maternity, and others.

Show Topic: Parallels in Patriotism: Educating America One Generation at a Time – History of Immigration & Bigotry, Then & Now

Discussion • Jewish Holocaust, •Armenian Genocide • Central American Migration  How immigrants have been migrating for thousands of years and have provided the fabric of America like no other country on the planet. How many cultures were once demonized yet became integral to the building of a great nation, despite being met with contempt by ethnic cultures preceding them. How many twentieth century cultures and races have escaped oppression and genocide to find a home in America compared to those in the twenty-first century who flee to escape gang violence and death, economic instability due to national strife and climate change. Discussion contrasts the days “undocumented” immigrant/migrants landed at Ellis Island, to modern day “undocumented” immigrant/migrants at our southern border. Program provides a wealth of information on the history of our nation’s founding, and where it may be headed in this new age of migration.

Guest: Adam Strom, Director of Re-Imagining Migration, an education project working with a team of experts from UCLA and Harvard Graduate School of Education. The focus of their work is to bring history and understanding of past immigration–and its current day analogs to classrooms and educational leaders across the globe. Show Topic: Polarization in Public Education: Teaching “Democratic” Values in a Trump-Era Democracy–Teaching Ethics, While Deescalating Prejudices in the Classroom

Discussion: on how educators have to deal with children whose families have raised them with beliefs and stereotypes about cultures that can bring disruption to the classroom, and how educators need to diffuse and bring inclusivity to the classroom. Case scenarios are discussed including diffusing first graders who want to literally “build a wall” in their classrooms to keep the Mexicans out! The dynamics of inclusivity and quelling of ostracism are discussed in a way that educators need to both hear and apply, to create a holistic-classroom learning environment.

Guest: Dr. Meira Levinson, Professor of Education at Harvard University’s Graduate School of Education. She is the founder of justiceinschools.org an organization devoted to providing information on ethical issues in education. She has also published a number of books on ethics and the dilemmas public school educators face in the modern-day classroom–much of which is a new phenomenon in the new Trump-Era “democracy”. She has published a number of books, including her newly released book: Democratic Discord in Schools: Cases and Commentaries in Educational Ethics, in addition to her previous book: Dilemmas of Educational Ethics: Cases and Commentaries.  Dr. Levinson holds a doctorate in political theory from the University of Oxford in the UK, and a BA in philosophy from Yale University.

Show Topic: Digital Dilemmas in Public Education: Privacy, iPads & ICE

Guest: Dr. Meira Levinson, Professor of Education at Harvard Graduate School of Education & founder of JusticeinSchools.org

Discussion on how on how school policies have been making student’s more vulnerable to intrusion even at home with the use of technology, such as their school-issued iPads, issues about who and when students are being monitored, who sees the information being monitored and how is it stored. Issues of conflict of interest are also discussed where often school resource officers are tasked with keeping students safe at school–but may moonlight for ICE and may very well raid the homes of students that they keep safe at school during the day. A fascinating, and also frightening account of how technology can encroach on personal privacy without students and their families even knowing.

Show Topic: The CarbonNation: Rolling Back Climate Change One State at a Time-

The Massachusetts Model of the Green New Deal, Creating Renewable Energy & New Green Jobs While Combating Climate Change with a Carbon Tax Rebate

Discussion on how to bring Renewable Energy to the homes of citizens across the Commonwealth of Massachusetts to serve as a model for the rest of the nation.

Massachusetts has already been a leader in solar energy, and now with coastal wind farms, now Massachusetts is poised to set new records for renewable energy generation. As a progressive state, and a green-energy leader: state legislators are proposing the “first in the nation” & “revenue neutral” Carbon Tax Plan with accompanying “rebate” for homes and businesses that go green. The model has been successfully implemented in the province of British Columbia, Canada, but not here in the USA. Massachusetts leaders are determined to find a way to combat climate change, while benefiting the air and water quality around the state to improve quality of life for its citizens, while at the same time, creating new “green” jobs. A worthwhile discussion for those who don’t want dangerous fossil fuel and pipelines to determine the health of the planet, or destroy their neighborhoods.

Guest: Massachusetts State Senator, Michael Barrett.  The Senator is a Harvard College graduate, a MA multiple term state legislator, a lawyer, and a tireless advocate for a healthy environment. He serves as a Senate Chair of the Legislature’s Committee on Telecommunications, Utilities & Energy. He has been an outspoken advocate on renewable energy and bringing clean energy jobs to the state of MA. Through his advocacy, he has put the Massachusetts ‘revenue neutral’ plan to combat climate change in the spotlight. This “model” can be adapted for “all” the states that embrace the necessity for clean energy, clean water and a clean environment for their citizens—all while providing financial incentive to do so.

Show Topic: Sexual Assault, Recent Judgments & #MeToo – Is America Moving Closer to Equal Rights for All?

Guest: Attorney Wendy Murphy. She is a former prosecutor now working as a “victim advocate” and “impact litigator” to assist abused women and children  –  bringing change to how the courts, legislators, and the public view violence against women and children. She has written numerous briefs in both federal and state courts on Sexual Assault, to violations of Civil & Constitutional Rights – taking place on College Campuses & in the Workplace. Many of her cases and issues are of first impression (never before litigated) in MA and around the nation. She is an adjunct professor of sexual violence law at New England Law – Boston, and often appears as a legal analyst for a variety of news outlets including CNN, PBS & Fox News.

Discussion centers on the fact that the Equal Rights has never passed the 38 states needed for ratification as a Constitutional Amendment. Currently, 37 states have given the nod ratification, including Illinois in 2018–becoming the 37th state. Unfortunately, only the Virginia Senate voted to Ratify–the Republican-controlled House of Delegates (state representatives) shot it down. So which state will step up to the plate and finally put women on “constitutionally prescribed” Equal Footing with Men–we will have to wait and see.

Other points of discussion include sexual assault legislation that is being implemented by the new Secretary of Education, Betsy DeVos to weaken Title IX–the federal statute that prohibits discrimination in education based on “gender.” In essence, Secretary DeVos, through her execution action is making it “harder” for victims of sexual assault and rape to have justice on college campuses. Seem absurd–Ms. Murphy discusses the travesty of justice when so many rapists and sexual aggressors are getting merely probation for heinous acts against women and girls. Watch, Learn & Rally for “REAL” Justice–and Against the “NEW” Female Justice Reform Under the “Trump” administration. Reform that makes it more difficult for victims to report and prosecute–and easier for dangerous criminals to go free.

Ms. Murphy’s book, And Justice for Some is a riveting compendium of insights as a prosecutor as well as a victim advocate – on how lawyers and judges let dangerous criminals go free.

Show Topic: Corporate Personhood: How Big Business, Big Money & Politics is Hijacking the US Constitution

Guest: Attorney Shanna Cleveland. She is Sr. Counsel at ‘Free Speech for People’ an organization devoted to renewing our democracy, taking big money and corporate interests out of politics & stopping the misuse of the US Constitution by Corporations.  She has been Sr. Atty. for a number of political & environmental organizations including the Conservation Law foundation where she worked in the Climate & Clean Energy Programs. She has received awards including one presented by our former MA State Supreme Court Chief Justice for her work – providing Access to Justice. She graduated magna cum laude from Harvard College, and earned her JD from University of Virginia Law School (UVA)–while serving as Executive Editor of the UVA Law Review. Atty. Cleveland received her LLM (Master of Laws degree) magna cum laude from Vermont Law School.

Discussion centers upon how the concept of corporate personhood, an artificial artifice to enable corporations to extract the benefits that humans do, the right to vote, the right to give money to big business interests and the right to have a very loud voice at the table–something that would not be possible without the title of “corporate personhood.” Yet, this artifice did not come about by happenstance. The historical underpinnings was a well-choreographed effort by an attorney for Big Tobacco who made his way to the US Supreme Court during the Nixon administration. That justice, not only took his corporate prejudices to the bench, but wrote a “playbook” that was utilized to spark renewed interest in corporate personhood, and was a leading catalyst to breathe renewed life into the case of Citizen United–allowing big money to infiltrate the political process to favor corporations and big business.

Most troubling for the democracy, the “Justice” withheld his “playbook” information from the confirmation hearings–an all too important reminder why “full disclosure” and open discussion is imperative to Judicial Confirmation Hearings. Attorney Cleveland identified numerous reasons why ethical accountability and full disclosure into judicial confirmation hearings is critical–and it must be overhauled to ensure that nominees have and will be accountable to the American people and not beholding to corporate interests. With the polarization now in Congress and the recent US Supreme Court partisan hearing–there is no doubt that reform is in order to save the American democracy.

Show Topic: Making the Connection: How Herbicide Use Correlates to Modern Disease

Guest: Dr. Stephanie Seneff, Sr. Research Scientist at the MIT Computer Science and Artificial Intelligence Laboratory. Dr. Seneff holds multiple degrees from MIT including: Biophysics, Nutrition, Electrical Engineering, and Computer Science.

Dr. Seneff’s research has identified a number of correlations between the widely-used herbicide “glyphosate” also known as  “Roundup” used on many food crops and now believed to be linked to many modern-day diseases. This diseases range from auto-immune to MS to Cancer.  The recent legal case in the US against the makers of Roundup, Monsanto, has supported Dr. Seneff’s claims about a causal link. The first case of its kind against the herbicide maker, Monsanto, the jury awarded the dying father, Dewayne Johnson, a groundskeeper who routinely used the herbicide and suffering with non-hodgkins lymphoma with over $200 million, mostly in punitive damages against the herbicide maker. Punitive damages, not routinely awarded, send a powerful message that the jury found significant wrongdoing to the maker of the herbicide. Monsanto is appealing the verdict.

Additionally, Dr. Seneff has also identified correlations with toxic algae blooms she correlates to wide-spread use of glyphosate on sugarcane fields in the state of Florida. As a seasoned MIT researcher, her work  is at the intersection of human biophysics and data analysis. She has conducted extensive analysis of data from studies conducted on these very topics.Dr. Seneff has coauthored numerous white-papers and has given numerous testimonies and lectures. Her work includes data analysis on the processes involved in identifying and determining causal events, etiology and methods of prevention. Show Topic: Gerrymandering: Where to Draw the Line… How Partisan Gerrymandering is Used to Discriminate & Disenfranchise–Weaponized to Dilute the Vote & Keep the Incumbent Party in Power

Guest: Dr. Daniel Breen, J.D., PhD, is a Lecturer of Legal Studies at Brandeis University, Waltham, Massachusetts. He holds a J.D. in Law  from the University of Georgia, and a Ph.D. in American History from Boston College.

Discussion on how gerrymandering began, why it has remained, and when or if the US Supreme Court may be unseating the concept of entrenched partisan gerrymandering as new cases come before it. Dr. Breen, lectures on the issues at the intersection of American History and the law. This is an ‘eye-opening’ discussion on how gerrymandering–drawing voting district lines–is all often “calculated” and implemented as a ‘subtle’ means to weaponize discrimination. By marginalizing blocks of voters–usually black & brown voters–diluting the impact of their vote by “packing and cracking” the district–so those in power who set the rules–stay in power; by keeping the status quo, minority voters and non-incumbents can be disenfranchised from the power of their vote. This process of ‘vote dilution,’ has the power of chill dissent  and quell voices of what should be a ‘representative government’– a concept that is paramount to having non-racial and bipartisan voting.

Exploration of election practices: how our nation can reverse the effect of gerrymandering that has so openly fragmented our state and national elections. It is axiomatic that no one should disenfranchise voters or dilute the “one person – one vote” requirement of the democratic election process. The discussion centers on constitutional issues surrounding the use of of gerrymandering by state legislatures–with the purpose & effect of keeping the incumbent party in power. The result undoubtedly influences the outcomes of each states’ federal congressional elections, as well influence party representation within the state itself. There will be a review of current US Supreme Court cases presently under review.

Dr. Breen’s lectures on a variety of presidential historical topics on the historical and legal underpinnings of or democracy on invidious discrimination against minorities and women.

Show Topic: Going Dark or Getting Personal? The Battle Between Data, Privacy & Our Constitution

Guest:  Attorney David O’Brien, Sr. Researcher at the Berkman Klein Center for Internet & Society at Harvard University makes guest appearance on the The Legal Edition-Legal, Business & Policy News for the Second in a Series, “Going Dark, or Getting Personal?” the continuing discussion on the “Going Dark” debate. Attorney O’Brien and The Legal Edition Host: Attorney & Policy Consultant, Mary Kay Elloian, engage in legal and practical dialog on cybersecurity affects our Constitutional protections against unwanted intrusion into our personal and business affairs.

Discussion: How cybersecurity may manifest as warrantless intrusions and violations of Constitutional protections afforded by the First, Fourth, and even the Third Amendment to our US Constitution. Discussion includes what individuals and businesses need to know about the scope of warrantless intrusion by governmental actors: intrusions that infringe upon Constitutional rights to privacy, and the warrant requirement. Also discussed, how nongovernmental hackers also pose a rick to our cybersecurity, through online piracy of private records and data mining–creating data breaches–and subjecting trade and proprietary secrets to potential theft and liability exposure–data that was supposed to be, and used to be secure.

Topics for discussion include what appears to be limitless modes of intrusion, and how protecting  private conversations & corporate secrets has never been so important. The questions and answers discussed only touch the surface of this provocative issue, but the implications are far-reaching. Can we ‘never’ expect to be alone…even when we think we are? How conversations and places once protected from intrusion–may never be private again. Further discussion on the Internet of Things (IoT) and how that is changing the issue of privacy and third party discovery in ways businesses and individuals never contemplated. Show Topic: GMO Fraud: Your Food, Your Health, Your Government

Guest: Public Interest Attorney, Steven Druker, Author of the Newly Released and Riveting book, ‘Altered Genes, Twisted Truth-How the Venture to Genetically Engineer Our Food Has Subverted Science, Corrupted Government, and Systematically Deceived the Public.’

Attorney Druker is the Founder of the ‘watchdog’ group, Alliance for Bio-Integrity.

Discussion delves into the science of GMO’s, the laws that are in place to oversee GMO’s, and the FDA’s systematic non-adherence to its own policies to favor biotech giants without any indicia of independent testing–or even testing by the FDA! Unlike what most people believe to be a government agency protecting the health of the people from toxic or potentially hazardous food, the FDA has a ‘voluntary’ system whereby GMO food manufacturers do not even need to inform the FDA of bringing new products to market. Through the suit launched by Attorney Druker’s nonprofit watchdog organization, the ‘Alliance for Bio-Integrity,’ along with several other plaintiff’s, were able to obtain, through discovery, information about what the FDA knew about GMO’s and when they knew it. The information gleaned from the FDA was enormous. With over 44,000 pieces of evidence that otherwise would not have been discoverable, but for the suit–startling information about American food safety came to light. To learn that no one was monitoring for potentially hazardous GMO’s, even though top scientists warned those who head the agency. After listening to the evidence presented, you will ask, ‘Are we left to our own devices?’ Will labeling be enough to protect the public from these hazardous GMO’s? Learn the truth about Food Labeling Legislation, Whistleblowers, and Congressional Inquiries into GMO Food Safety. You should be shocked–but not surprised. Government regulation leaves much to be desired to protect the public. For more information on the author, Steven Druker, and his fight against the fraud of the FDA, visit:  http://www.biointegrity.org/ and also visit The Legal Edition Publications and Blog section of this website for more information on the GMO legislation, toxic ‘designer’ herbicides, and GMO free labeling and organics.

Show Topic: Toxic Teeth-Toxic Truth: Mercury, Amalgams & the FDA – Two Part Series (Part 1 & Part 2)

Guest: Dr. Mark A. Breiner, DDS, Author of  Whole-Body Dentistry and founder of the Breiner Center for Whole-Body Health.

Dr. Breiner is speaking out on Mercury-Amalgams, and how it is classified everywhere as hazardous waste–expect when it is placed in the human body! Dr. Breiner discusses scientific studies tracing the root of disease to mercury in organs of the body. He also provides insight into his approach to obtaining optimum health. His whole-body approach to remedying illness brings to light health related issues that may dental practitioners and even physicians may overlook. However, as Dr. Breiner points out, there is a connection between dentistry and whole-body health–one affects the other. The book is a page-turner filled with scientific facts including conductivity of metals, electrical currents in the mouth and body, leakage of mercury to distance sites in the body, and the fact that mercury is a neurotoxin that crosses the blood brain barrier, and can be passed on to a developing fetus. The foreword of the book is written by well-known cardiologist, Stephen T. Sinatra, MD, Author of ‘Reverse Heart Disease Now.’

The book, Whole Body Dentistry’ is the WINNER of the 2012 Global E-Book Awards/Medicine and Healthcare, and a Finalist in the Book of the Year Awards!

Discussion: Although the FDA considers Mercury to be Hazardous and one of the most deadly substances on earth, outlining policies for its delivery to dental offices and where the EPA sets guidelines for disposal once removed from patients–there is no information provided to consumers to warn of the potential for devastating health effects on adults, children–and especially pregnant women and their unborn fetuses. Yet even though the FDA & ADA do not acknowledge that amalgams can be unsafe in many people, the International Academy of Oral Medicine & Toxicology deems it otherwise. Now banned in Norway, Sweden, Denmark, Russia–-and even in Japan-–amalgams are getting the attention outside the US that it deserves. But what about here at home? Explored are the devastating effects of systemic poisoning to include what appears to be autistic symptoms, cognitive deficits, MS, Lupus and more. So why are consumers not informed for the potential for illness when they go to their dentist? Why are they not informed that they have choices and alternatives to amalgams? Further discussion on alternative dental practices that take into account the ‘whole body’ to help achieve homeostasis and a disease-free state.  Whether it be a cavitation, or an energetic imbalance in a body system or a tooth affecting a vital energy meridian–-Dr. Breiner explains the disease process and the road to wellness. This is an eye-opening discussion for everyone who has head a health problem that has evaded detection by their doctor or dentist–follow the detective paradigm with Dr. Breiner. Also discussed the first successful amalgam litigation case in the US. So stay tuned for more of The Legal Edition!

Topics of discussion include: environmental contaminants to vaccines, and traditional uses of toxic metals in medicine–etiology, manifestations and potential for new disease. Also to be discussed will be the recent US Supreme Court Case, Michigan v EPA, to which the Court just ruled that the EPA overstepped its boundaries–not fully assessing the cost to corporations to meet more stringent  regulations of compliance for emitting coal-based mercury and other toxic contaminants into the environment. Contaminants that find their way into our lakes and streams–further tainting the human food supply and the environment. To learn more about this insidious and pervasive issue and how corporations, special interests and our government allows this to continue, watch for this upcoming program ” Autism & Environmental Toxins: Mercury, Medicine and Money” on The Legal Edition.

Show Topic: Vaccine Mandates: Greater Good or Greater Greed?

Guest: Attorney, Scholar, Mary Holland–Research Scholar at New York University Law School, and Co-Author & Co-Editor of the Best Selling Book, ‘Vaccine Epidemic’

‘Personal Liberties Under Siege’ The Usurpation of Individual Rights Under the Guise of Promoting Public Health

Discussion will include the US Supreme Court case of Jacobson v Massachusetts (1905), in which vaccine mandates were mandated under a full-fledged smallpox epidemic in Massachusetts–pay a fine-or take the vaccine. Discussion will also include the current vaccine legislation to remove exemptions that have afforded many in states across the country a reprieve from vaccines that can harm and injure, but the oppressive and contrived nature of the urgency of such legislation. Also discussed, the revolving door between our government agencies charged with protecting the public health, and their ties and allegiances to BigPharma. Discussion includes CDC Whistleblowers, and those who falsified data at the CDC–now fugitives from the law. Background: Historically the US has passed laws that have irreparably tarnished the reputation of the US, such as forced sterilizations of children and adults notably poor that were earmarked as ‘defectives and imbeciles’ and sterilized ‘for the common good’–under the 1927 US Supreme Court decision Buck v Bell; where rampant experiments such as the Tuskegee syphilis experiment clinical study conducted between 1932 and 1972 by the U.S. Public Health Service to study the natural progression of untreated syphilis in rural African-American men in Alabama; and the internment of Japanese-Americans during WWII under Korematsu depriving them of their liberty and their property–all under the guise of promoting the public good.

Throughout American history, these deprivations of personal rights stand eternal as grave reminders of the effects of overreaching and overzealous government and bureaucrats. Notably, these home-grown indignities greatly tarnished the American reputation for liberty and personal freedoms–serving as a template for the Nazi use of ‘experimentation’ in their internment camps during WWII (1939-1945). During the Nuremberg trials during WWII, the Nazi’s referred to their torturous and barbaric behavior as ‘medical experiments’ and used the American indignities on its own people as justification for leniency in the trial of their War Criminals during WWII. There can be doubt these cases stand as irreverent reminders of our nations darker past, and color the view of America in the international community. Our history here stands in stark contrast to the American values of liberty and freedom for all its people. Today, America is once again at a crossroads–legislators making choices for the individual, or for the common good. Yet these choices appear to be founded upon the same pillars of those in our history. Protecting Society for the’ Greater Good’ has proven to have Greatly Failed. That burden and seriously tarnish our history and our Constitution–it has usurped our Personal Rights and Liberties.

Now, the American government engages in its own justification of another assault upon its own people–now doing so under the guise of Promoting Public Health–Mandating Vaccines, and Curtailing Vaccine Exemptions. Once again, trying to force the greater good — has always greatly failed — and has always left a nation and its people severely, and irreparably divided. With that as a backdrop, one must ask–who will ultimately benefit from forced mandates and the further erosion of personal rights and  liberties? Hasn’t history already given us the answer? To learn more about the History of Personal Liberties & the Importance of Standing Up for Personal Choice and Freedom–look for this upcoming program. Vaccine Mandates: Greater Good or Greater Greed? You decide…

Show Topic: Makers, Takers and the 47%–The New Wave of Safety Netters Catapulting out of Poverty and Into New Age Entrepreneurs

Guest: Dr. Gareth Olds, Ph.D., Assistant Professor of Business Administration-Entrepreneurial Management-Harvard Business School Discussion will focus on the New Breed of Social Entrepreneurs that not only use or vie for the ‘Safety-Net,’ but Utilize it as a means to Catapult Themselves Out of Poverty and into ‘Roles’ as New Age Entrepreneurs. Based on Dr. Olds’s years of Research–gone should be the stereotypes that ‘Once in Poverty-Always in Poverty’–which some in society have labeled as ‘Perpetual Takers.’ Instead, what Dr. Olds’s research has shown, is the ‘Presence’ of the Safety Net, whether it is used or not, has ‘Forged a Route’ that would not otherwise exist–a Route that can Catapult those in Poverty into new roles as ‘Social Entrepreneurs.’ To ‘take a chance’ has always been the American Dream–to become creators–the so called ‘Makers’. Yet, the market forces of Today are Highly-Competitive–incomparable with those of years past when the first immigrants came to this country to make their way. Today, market forces are leaving those on the ‘Lower Economic Rungs’ with a much steeper ladder to climb. Whether disadvantaged by lack of Education, declining Health, or just plain Poverty–None of these should define one’s financial future. Most Importantly, Dr. Olds’s Research Data Shows that the Safety-Net is in fact, giving a Boost–‘Intended or Not’–to those ‘Willing to Take the Risk.’ New data shows the Safety-Net has become a Trampoline–there to help those who vie for it  to reach new Heights–yet there to catch them when or if they should Fall. For without the Safety-Net, those wanting to Climb the traditional Ladder out of poverty Rung by Rung, would have No Way Out. Most importantly, Dr. Olds will discuss how the Public Misconception that 47% of the Population are just Takers–‘preying upon’ the 53% of Makers is factually and statistically incorrect. In fact, his research shows this belief has always been a Stereotypical Artifice of a more Affluent and Privileged class. Time permitting, discussion will include health and labor economics, applied econometrics, and the supply of entrepreneurial talent for start-ups; the importance of interpersonal trust in reducing credit market frictions and facilitating entrepreneurship; and the impact of public healthcare programs on insurance crowd-out and medical innovation. It is this cumulative effect that public healthcare and income support programs have on helping safety-net households to establish firm footing in the new Entrepreneurial Arena. Professor Olds earned his Ph.D. in Economics at Brown University in 2014, where he received the Merit Dissertation Fellowship, the National Science Foundation’s IGERT Fellowship (for an interdisciplinary program on poverty and inequality), and the Graduate Teaching Award. He also holds an A.M. from Brown University and a B.A. from Whitman College in Walla Walla, Washington, where he was a member of Phi Beta Kappa. He is originally from Anchorage, Alaska, and is a Safety-Net Survivor. Show Topic: The Next Generation: From Pipelines to Propaganda-Putting the ‘Best’ Energy Policies to Work [Roundtable Discussion]

Guests: Massachusetts State Senator James ‘Jamie’ Eldridge, Vice-Chair of the Senate Committee on Global Warming and Climate Change and Member of the Joint Committee on Telecommunications, Utilities and Energy; Jim O’Reilly, Director of Public Policy at Northeast Energy Efficiency Partnerships (NEEP)–Join The Legal Edition Host & Producer, Attorney Mary Kay Elloian. An-In-Depth Roundtable Discussion will focus on Energy Policies and Energy Needs in the Commonwealth of Massachusetts, and the Northeast–while exploring how Implementing a Responsible Energy Policy and Renewable Energy Generation Infrastructure can be a model for the entire Nation. In contrast to these goals, discussion will include current proposals for new pipeline infrastructures across the region with a First of its Kind Proposal for a ‘tariff-based’ cost recovery system proposed by the Energy Company itself. As proposed, the new pipeline would carry high-volume, highly volatile,  pressurized, ‘fracked gas from the Pennsylvania Marcellus shale deposit to the northeast region. The proposed system would be a gas–storage and delivery system–which would allow for pressurization and storage of gas during all seasons. As proposed, it would navigate through sensitive environmental terrain, near schools, homes, businesses, and watersheds which provides safe drinking water to thousands of people in the Commonwealth of Massachusetts.  Along the 400 mile route of pipeline would also be compressor stations–to consume a 100 foot swath of land and private property in its path–with the effect of diminishing land and home values affecting their saleability, insurability, and jeopardizing covenants of mortgaged property. The premise of the gas pipeline proposal is to bring additional energy to the region for home use and electricity generation–while at same time the energy company states its goal is to also export the gas it brings to outside the US. However, to export would bring higher profits to the energy company–while bringing substantial costs to the local environment and every rate payer in the region.

With the laws of Supply & Demand in the Balance–the end result could very well be higher costs for US rate payers once exports are increased. Discussion will include what the energy data needs assessments really show are the current and projected energy needs of the region, while addressing best practices on how those energy needs can be met. With climate change looming and terrorism in the news,  renewable energy is now making its way into the forefront of clean energy generation–now is the time for discussion on how to put those new energy measures to work. Discussion will include data analysis and best practices to bring clean energy to consumers, while at the same time offering new solutions to meeting energy needs and minimizing negative effects on the environment. Discussion will include New Energy Generation Initiatives that will not only protect sensitive wetlands, farmlands–and human health and safety–but will ultimately address the elephant in the room–climate change. This is one show that Legislators, Consumers, and Energy Policy wonks won’t want to miss. Also see: www.TheSolutionsProject.org for more information on how to make each and every state –totally Renewable Energy Driven! Show Topic: The New Food Order: How Glyphosate, Herbicides & GMO’s Are Shaping Our Future – & What the Food Industry Doesn’t Want You to Know

Guest: Dr. Stephanie Seneff, Ph.D., Senior Research Scientist at the MIT Computer Science and Artificial Intelligence Laboratory. She holds multiple degrees from MIT including:  B.S. in Biophysics, M.S. and E.E. in Electrical Engineering, Ph.D degree in Electrical Engineering and Computer Science. Her Approach Includes Analysis and Synthesis of Data from Research Literature & Web-Based Epidemiological Data Related to Health and Environmental Toxins. Discussion focus: Herbicides and GMO’s are all around us–but are they safe? So much information in the media–but is that information ‘unbiased?’ Learn more from a Senior Research Scientist from MIT who is not only using her skills as a formidable researcher in biological sciences but is combining her research and deduction skills using super computers to garner and parse unfathomable amounts of information. From raw research data to full-blown studies from around the globe, Dr. Seneff will share her findings and her opinions based upon years of researching scientific papers, studies and peer reviewed journal submissions. She will answer the question based upon her years of research study and evaluations of scientific literature whether Herbicides are truly safe, and how they work synergistically with GMO crops and other toxic chemicals in the environment today. Discussion will include how will the new Frankenfoods of today could affect us tomorrow and down the road–and the Public’s Right to Know What’s in Their Food. Additional discussion will include Updates on Truth in Labeling Litigation currently ongoing in the Northeast in the state of VermontLitigation by Food Industry Trade Groups & Big Business Aimed at Preventing the State of Vermont from Putting their Labeling Law in Effect–even though the Governor of Vermont already signed the Labeling Bill into Law. One might ask, why would big business spend millions of dollars on fighting truth in labeling? That is, if they truly believe their products are just as good, and substantially similar to conventional products? If you are unsure–watch the upcoming episode of “The New Food Order…” on The Legal Edition.

Show Topic: Our Oceans–Our Survival–One Earth (Two Part Extended Edition) – Part TWO Series  –  See Part 1 & Part 2  on YouTube & TheLegalEdition.com

Guest: Dr. James J. McCarthy, Ph.D., Alexander Agassiz Professor of Biological Oceanography at Harvard University; Former Director of Harvard’s Museum of Comparative Zoology; and Co-Author on the First Intergovernmental Panel (IPCC) Report on Climate Change. Dr. McCarthy is also a Fellow of the American Association for the Advancement of Science (AAAS); a Fellow of the American Academy of Arts and Sciences; a Foreign Member of the Royal Swedish Academy of Sciences; Past President and Chair of the Board of Directors of the AAAS, our Nation’s Largest Scientific Association; and Current Chair of the Board of Directors for the Union of Concerned Scientists. Additionally, Dr. McCarthy served as the first chair of the international committee that establishes research priorities and oversees implementation of the International Geosphere – Biosphere Program (IGBP); Founding Editor for the American Geophysical Union’s Global Biogeochemical Cycles.  For the past two decades Dr. McCarthy has worked as an author, reviewer, and as a co-chair with the Nobel Peace Prize winning Intergovernmental Panel on Climate Change (IPCC).  For the Third IPCC Assessment, he headed Working Group II, which had responsibilities for assessing impacts of and vulnerabilities to global climate change.  He was also one of the lead authors on the Arctic Climate Impact Assessment, and a Vice-Chair of the 2007 Northeast Climate Impacts Assessment. Dr. McCarthy is also the Recipient of the New England Aquarium’s David B. Stone award for distinguished service to the environment and the community. Program discussion will focus on his role in Co-Authoring one of the First Intergovernmental Panel on Climate Change Reports (IPCC) in 1990, and subsequent climate change reports. He will discuss the state of our oceans and its importance to our own survival: from the glaciers in Greenland to the ice shelves in Antarctica–melting in the poles has been unprecedented on the past decades with no end in sight. This program will dispel the myths of whether melting is actually occurring and why. Melting of the polar regions is not a new phenomenon–yet the rate of melting is unprecedented. Discussion will include: acidification, carbon, disappearing ice shelves and coral reefs, and extinction of key marine populations essential to the biological health of our seas. Discussion will also include drilling for black gold–how both drilling and pollution affects the biology and chemistry of our oceans–and the marine populations that inhabit it. This is one program that everyone who cares about preserving our great oceans–and ultimately ensuring our own survival must see!

Show Topic: Managing the Risks of Climate Change While Averting Economic Disaster (an overview)

Guest: Dr. Dale Jorgenson, Ph.D., Samuel W. Morris University Professor of Economics at Harvard University, and Professor of Policy at John F. Kennedy School of Government–and Author of the newly released book on the Economics of Climate Change Mitigation:  “Double Dividend” and Nobel Prize Nominee.

Dr. Jorgenson–past President of the American Economic Association in 2000–and named a Distinguished Fellow of the Association in 2001. He served as a Founding Member of the Board on Science, Technology, and Economic Policy of the National Research Council in 1991; and Chairman of its Board from 1998 to 2006. Additionally, he served as Chairman of Section 54, Economic Sciences, of the National Academy of Sciences from 2000 to 2003; in addition to holding office as President of the Econometric Society in 1987. He is the recipient of several prestigious awards, and has authored more than 36 books and 300 articles on Economics. He most recently co-authored, Double Dividend: Environmental Taxes and Fiscal Reform in the United States. Discussion will focus on the issue of climate change, recent EPA rulings, in addition to economic productivity and the overwhelming need to minimize economic loss. With the increase in the frequency and intensity of violent storms, extreme weather conditions–as well as arid growing conditions–business and industry must brace for the additional costs of lost productivity, loss of property, loss of life, and increase in insurance costs that may drive prices higher than ever anticipated by consumers and CEO’s. Yet, the cost of doing nothing about climate change is no longer a viable option–as insurers refuse to underwrite high-risk areas of the country as well as the most vulnerable industries. Unlike the past, costs of rebuilding infrastructures may no longer be be borne by the government to reestablish communities devastated by coastal storms, inland hurricanes and tornadoes–especially where insurers had refused to underwrite them and Congress has not appropriated monies to rebuild. Whether acknowledged or not–climate change is here to stay..and policymakers need to stop that debate and start finding solutions to manage its affects. Experts agree–we are in uncharted territory with no time to spare–and as a result of procrastination and spurious debate–we must mitigate the risks in ways unprecedented in the past. This is one show that not only will focus on the financial affects of climate change, but the devastating market affects on the economy and on the American public if left unabated. Like it or Not–the Scientific Majority are in Consensus–climate change is real! The time has long passed on that debate..Now it’s time to find solutions. This is one episode of The Legal Edition that will give economic and policy assessments to this oft debated and often ill informed issue. Dr. Jorgenson, a much sought after scholar on the Economy & Climate Change provides solid, empirical, evidence-based discussion on whether climate change is real and the economic effects that will occur if left unabated. This is one episode of The Legal Edition that will provide economic assessments and mitigation strategies of one of the most critical issues of our time.
