Dec. 10, 2014 – Now that so many states are legislating for Bio-Engineered Food Labeling (GMO Labeling), the US Congress now has a Bill before it that many are calling ‘The DARK ACT’ which if passed, would obscure labeling even further. Under the Tenth Amendment to our US Constitution, states have a right to legislate in the best interests of their people if the Federal Government has not legislated or has not occupied the field in a particular area. That means, that if there is no federal law, such as a labeling law for GMO foods, the states are free to legislate within their borders as their own sovereigns.
However, because we are the UNITED STATES, each state must bend to acknowledge a Federal Rule in place that would set the standards–much like the case of the California CAFE Standards for fuel efficiency, California citizens chose to set standards above the minimum requirements for efficiency set by Congress. Californians’ wanted to make their air cleaner than the rest of the country–and they could do this because the Federal Law did not prevent them from doing so. However, in the proposed DARK Bill, proposed by a vast majority of Republican legislators and a small minority of Democratic legislators in Congress–such would not be the case. In fact, the proposed House Bill, H.R. 4432 would PREVENT states from making their own GMO labeling rules, and as it reads would obscure labeling even further–with the exceptions for GMO labeling swallowing the rule.
You might ask, ‘What is the intent’? The intent is to foreclose states like Vermont, Connecticut and Maine that have already passed GMO labeling legislation from ever taking effect. In legal terms-chill their speech and prevent them from talking about it–or making laws about it. Sounds like a First Amendment violation of the consumers’ and states’ rights to do what’s in their own best interests and that of their constituents–that is talk about and make rules about what is important to their health and well-being–here, the Right to Know what’s in their food!

In reading the briefs in the current litigation by the Grocery Manufacturers Association, et al.*, of which Monsanto and many others who do not wish to be identified fall under the umbrella of ‘plaintiff’ litigants,–who don’t want you to know who they are, what products they produce, and that they are fighting against their own consumers’ right to know–that’s you! It is clear, they do not want ‘you’ to know what’s in your food, or how it was raised. Through their litigation, they are telling the court they are fighting against labeling–claiming in essence, that having to tell you what’s in your food would VIOLATE THEIR FIRST AMENDMENT RIGHT TO FREE SPEECH! Well I don’t know about you, but if someone won’t tell me what’ in the food I eat or feed my family, I ask the question ‘What Have You Got to Hide?’! Hence inciting my speech, and my pocketbook to go in the other direction.
I believe this is why these ‘manufacturers’ are suing the state of Vermont–the only state where such legislation is slated to soon take effect! You must know, these manufacturers are running scared–not because they fear their free speech is violated, but because they would be forced to tell you something they don’t want you to know–that is that genetically altered food is not the same as naturally raised or hybridized foods. These ‘frankenfoods’ not only do not have the same amount of nutrients as conventionally raised and produced foods–they produce their own toxins to kill weeds and insects that may eat them–and knowing this will make you wonder what they may do to you!
And last but not least, we cannot forget the herbicides, (which are in essence pesticides for plants) that will make these GMO manufacturers more money-as farmers are literally sold a bill of goods, that is they have to buy both the one time use GMO seed and apply applications of these toxic herbicides (which they won’t tell you are toxic)–all of which will make ‘these GMO seed & herbicide corporations’ lots of money. To see how good this system really works, look to the farmers of India who are committing suicide faster than you can plant a row of corn. Why you might ask? The reason, is they have spent all their money, time and hard work to have a lesser yield, for higher cost, with the outcome of tainted soil and water–in essence they have gravely diminished the future use of their land and that of their family’s future. They were literally sold a bill of goods that destroyed their livelihoods and their lives. So if you think GMO”s are the greatest thing since sliced bread–think again! Even Russia wants no part of them…and they are not alone!
